Modern developments around Woodberry Down, Manor House, Finsbury Park and Tottenham Hale offer contemporary apartments, landscaped grounds and convenient transport links.
However, buyers must understand the financial and legal responsibilities that come with owning a leasehold flat.
What does leasehold ownership mean?
When purchasing a leasehold flat, you own the right to occupy the apartment for the remaining term of the lease. The freeholder generally owns the building, structure and communal areas. The freeholder or management company will usually arrange repairs to the external walls, roofs, flat roofs, green roofs, communal windows, entrances and shared facilities. This does not mean the leaseholder avoids these costs. Leaseholders normally contribute through the service charge and may also receive separate demands for major works. The lease should also be checked before making alterations. Even internal changes may require written consent from the freeholder or management company.
Understanding the service charge
Service charges in modern developments can be substantial. Costs may include building insurance, cleaning, lifts, automatic gates, door entry systems, fire alarm panels, communal heating systems, concierge services, landscaped gardens and maintenance of green roofs.
Designer landscaping, water features and extensive communal grounds may look attractive, but they require regular maintenance. Buyers should understand exactly what is included, how charges are divided and whether costs have increased in recent years.
A reserve or sinking fund may be collected for future major works. However, a limited reserve fund can leave leaseholders exposed to unexpected demands for roof repairs, lift replacement, external decorations or fire safety improvements. What is the management pack?
The management pack, often provided through an LPE1 form, gives important information about the development. Your Legal Adviser should review the service charge accounts, current budget, reserve fund, building insurance, planned major works, outstanding disputes, fire risk assessments and any Section 20 notices.
Cladding and EWS1 forms
Taller modern developments may have cladding, insulated render systems or combustible balcony materials. An EWS1 form may be required by a lender depending on the building’s height, external wall construction and materials. It applies to the whole building and is not a general fire safety certificate.
